1. Definitions
In this Agreement, "Platform", "Participant", "Provider", and "Services" have the meanings given in the General Terms of Use.
2. Platform Role
2.1 The Provider acknowledges that FindMySupport operates a connection platform only.
2.2 FindMySupport does not provide Services, does not employ the Provider, and does not supervise, direct, or control the Provider's work.
2.3 FindMySupport is not a party to any agreement between the Provider and a Participant.
3. Provider Responsibilities
3.1 The Provider is solely responsible for the Services they provide, including their quality, safety, legality, and compliance with all applicable laws and standards.
3.2 This includes, without limitation, compliance with:
- NDIS requirements (where applicable);
- worker screening obligations;
- insurance requirements;
- the NDIS Code of Conduct; and
- Australian Consumer Law.
4. Warranties
4.1 The Provider warrants that they:
- hold all licences, checks, registrations, and insurance required for their Services;
- will maintain those requirements while listed on the Platform; and
- will provide Services with due care and skill and in accordance with law.
5. Truthful Advertising and Representations
5.1 The Provider must ensure that all information in their profile and communications is accurate, complete, and not misleading.
5.2 The Provider must not state or imply that:
- they are "NDIS approved" or "government endorsed"; or
- FindMySupport approves, certifies, or guarantees their Services.
6. Documents and Verification
6.1 If the Provider uploads or displays any documents (including screening, insurance, or registration details), the Provider is responsible for ensuring those documents are accurate and current.
6.2 Any verification or badge displayed by FindMySupport does not constitute endorsement, certification, or a guarantee of compliance or safety.
7. Relationship with Participants
7.1 Any agreement for Services is between the Provider and the Participant directly.
7.2 The Provider is responsible for their own contracts, pricing, cancellations, invoicing, and dispute handling.
8. Complaints and Incidents
8.1 The Provider must maintain a complaints handling process and comply with all legal obligations relating to complaints and incident management.
8.2 The Provider must cooperate with any lawful investigation or regulatory requirement.
9. Indemnity
9.1 The Provider indemnifies and holds harmless FindMySupport from and against any claims, losses, damages, liabilities, costs, or expenses arising from:
- the Provider's Services;
- any breach of this Agreement; or
- any breach of law or regulatory obligation by the Provider.
10. Suspension and Removal
10.1 FindMySupport may suspend or remove the Provider's account or listings if it reasonably believes the Provider poses a safety, legal, or compliance risk or has breached this Agreement.
11. Termination
11.1 This Agreement continues until terminated by either party in accordance with the Terms of Use.
11.2 Termination does not affect any accrued rights or obligations.
12. Governing Law
12.1 This Agreement is governed by the laws of New South Wales, Australia.
