Terms of Service

1. Definitions

In these Terms:

  • "Platform" means the FindMySupport website, applications, and related services.
  • "User" means any person who accesses or uses the Platform, including Participants and Providers.
  • "Participant" means an NDIS participant or their nominee using the Platform to find services.
  • "Provider" means an individual or business offering services through the Platform.
  • "Services" means disability support or related services provided by Providers to Participants.

2. About the Platform

FindMySupport operates a technology platform that enables Participants and Providers to find and communicate with each other.

FindMySupport does not provide disability supports, does not employ Providers, and is not a party to any agreement between Participants and Providers.

Any contract for Services is formed directly between the Participant and the Provider.

3. No Endorsement or Guarantee

FindMySupport does not endorse, recommend, certify, or guarantee any Provider or any Services.

Any profiles, ratings, reviews, badges, or verification indicators are provided for general information only and do not replace a User's own enquiries or judgement.

4. Accounts and Security

  • Users must provide accurate, complete, and current information.
  • Users are responsible for maintaining the confidentiality of their login details and all activity conducted through their account.
  • Users must notify FindMySupport immediately of any unauthorised use of their account.

5. Acceptable Use

Users must not use the Platform to:

  • Post unlawful, misleading, deceptive, or harmful content
  • Impersonate another person or misrepresent their identity or services
  • Harass, abuse, or harm another user
  • Interfere with the operation or security of the Platform

6. Content and Moderation

FindMySupport may review, remove, or restrict content or accounts that breach these Terms or create a safety, legal, or reputational risk.

FindMySupport is not obliged to monitor content but may do so at its discretion.

7. Platform Availability

FindMySupport does not guarantee continuous or error-free operation of the Platform.

The Platform may be unavailable from time to time for maintenance or other reasons.

8. Limitation of Liability

To the maximum extent permitted by law, FindMySupport is not liable for any loss, damage, injury, or dispute arising from:

  • (a) Services provided by a Provider; or
  • (b) interactions between Users.

To the maximum extent permitted by law, FindMySupport excludes all liability for indirect, incidental, or consequential loss, including loss of income, profits, data, or opportunity.

9. Termination and Suspension

FindMySupport may suspend or terminate a User's account if the User breaches these Terms or if their conduct creates a safety, legal, or compliance risk.

Users may close their account at any time, subject to any outstanding obligations.

10. Changes to These Terms

FindMySupport may update these Terms from time to time.

Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

Privacy & Contact

This Provider Agreement supplements the General Terms of Use. All defined terms have the meanings given in the General Terms of Use unless stated otherwise.

1. Platform Role

The Provider acknowledges that FindMySupport operates a connection platform only.

FindMySupport does not provide Services, does not employ the Provider, and does not supervise, direct, or control the Provider's work.

FindMySupport is not a party to any agreement between the Provider and a Participant.

2. Provider Responsibilities

The Provider is solely responsible for the Services they provide, including their quality, safety, legality, and compliance with all applicable laws and standards. This includes, without limitation, compliance with:

  • NDIS requirements (where applicable)
  • Worker screening obligations
  • Insurance requirements
  • The NDIS Code of Conduct
  • Australian Consumer Law

3. Warranties

The Provider warrants that they:

  • Hold all licences, checks, registrations, and insurance required for their Services
  • Will maintain those requirements while listed on the Platform
  • Will provide Services with due care and skill and in accordance with law

4. Truthful Advertising

The Provider must ensure that all information in their profile and communications is accurate, complete, and not misleading.

The Provider must not state or imply that:

  • They are "NDIS approved" or "government endorsed"
  • FindMySupport approves, certifies, or guarantees their Services

5. Documents and Verification

If the Provider uploads or displays any documents (including screening, insurance, or registration details), the Provider is responsible for ensuring those documents are accurate and current.

Any verification or badge displayed by FindMySupport does not constitute endorsement, certification, or a guarantee of compliance or safety.

6. Relationship with Participants

Any agreement for Services is between the Provider and the Participant directly.

The Provider is responsible for their own contracts, pricing, cancellations, invoicing, and dispute handling.

7. Complaints and Incidents

The Provider must maintain a complaints handling process and comply with all legal obligations relating to complaints and incident management.

The Provider must cooperate with any lawful investigation or regulatory requirement.

8. Indemnity

The Provider indemnifies and holds harmless FindMySupport from and against any claims, losses, damages, liabilities, costs, or expenses arising from:

  • (a) the Provider's Services;
  • (b) any breach of this Agreement; or
  • (c) any breach of law or regulatory obligation by the Provider.

9. Suspension, Removal & Termination

FindMySupport may suspend or remove the Provider's account or listings if it reasonably believes the Provider poses a safety, legal, or compliance risk or has breached this Agreement.

This Agreement continues until terminated by either party in accordance with the Terms of Use. Termination does not affect any accrued rights or obligations.

10. Governing Law

This Agreement is governed by the laws of New South Wales, Australia.

This Participant Agreement supplements the General Terms of Use. All defined terms have the meanings given in the General Terms of Use unless stated otherwise.

FindMySupport operates a technology platform that helps Participants find and connect with Providers.

FindMySupport does not provide disability supports and does not employ, supervise, or control Providers.

2. Choosing Providers

The Participant is responsible for deciding whether a Provider is suitable for their needs.

The Participant is encouraged to ask questions, check credentials, and satisfy themselves before engaging a Provider.

3. No Guarantee

FindMySupport does not guarantee the quality, safety, suitability, or outcomes of any Services provided by Providers.

4. Agreements with Providers

Any agreement for Services is formed directly between the Participant and the Provider.

FindMySupport is not a party to that agreement and does not manage or control the Services.

5. Disputes

Any dispute regarding Services should be raised directly with the Provider.

FindMySupport may provide tools to report concerns but is not responsible for resolving service disputes.

6. Reviews and Content

Reviews and ratings reflect individual experiences and do not represent endorsements or guarantees by FindMySupport.

7. Limitation of Liability

To the maximum extent permitted by law, FindMySupport is not liable for any loss, damage, or injury arising from:

  • (a) Services provided by Providers; or
  • (b) interactions between the Participant and Providers.

8. Termination

The Participant may close their account at any time, subject to any outstanding obligations.

FindMySupport may suspend or terminate accounts in accordance with the Terms of Use.

9. Governing Law

This Agreement is governed by the laws of New South Wales, Australia.
